The climate in a real estate transaction has changed. The conflict of
interest that occurs when a buyer is represented by the same real estate
firm as is the seller has become a serious issue with consumers. Buyers
are demanding and receiving representation in the real estate transaction.
When a buyer is represented by a real estate professional, this is called
Buyer Agency or Buyer Representation. The buyer and the real estate
professional have a client based relationship.
Because all real estate brokerage companies and their sales associates
are subject to the Common Law of Agency and their respective states regulatory
